Payment & Cancellation Policy

A deposit in the amount agreed upon is required at the time of signing this agreement to secure the event date. The deposit is non-refundable 30 days or less prior to the event date. The final payment or balance of funds owed is non-refundable 15 days or less prior to the event date. The final payment is due prior to the event date. Photo booth services will not begin until the balance is paid in full. Payment for any overage in time must be paid before additional hours are provided.

Access & Parking

All parking expenses for the provider's employees are the responsibilities of you, the client. Photo booth services will not be completed until parking expenses are paid, if they are not paid prior to the event. Parking must be provided within a reasonable distance from the photo booth set-up location. Client will arrange for access to the event space and will supply any necessary tickets, badges, or other items needed for entry to the Provider's representative at the Client's expense.

Setup Requirements

Client will arrange for an appropriate space for the photo booth at the event’s venue. The photo booth requires a space of 10’ deep x 10’ wide x 8’ high, but we recommend a 13 x 13 area for great full-body shots. The client is responsible for ensuring power is available for the photo booth (110V, 5 amps, 3-prong outlets on a dedicated circuit). If the photo booth is to be placed outdoors, the client agrees to provide complete overhead coverage for the photo booth and backdrop for the entire duration of the event.

Photo Booth Setup/Removal

The provider will deliver, set up, and remove the photo booth from the event location. Operation times may be adjusted if the event location or client ends the event prior to the contracted end time, and no refund of money will apply. The provider requires access to the venue at least 60 minutes before the event and 30 minutes after the event for setup and takedown.

Operations

Provider agrees to have the photo booth operational for a minimum of 85% during the scheduled period. Occasionally, operations may need to be interrupted for maintenance (e.g., changing photo paper, adjusting camera, adjusting printer, lighting, etc.) to achieve a quality product.

Change In Event Date

If the client changes the event date after signing this agreement, the provider will make best efforts to accommodate the new date. If the provider is not available on the new date, the provider shall be entitled to retain the initial retainer or 25% of the total service fee, and neither party shall have further liability under the agreement. If the event is rescheduled to the next calendar year, the new pricing in effect at that time shall apply.

Damage To Provider’s Equipment

Client is responsible for any damage or loss to the provider’s equipment caused by misuse or negligence by the client or guests, theft, or disasters (e.g., fire, flood, earthquake). Client also acknowledges the provider has the right to decline services to guests exhibiting inappropriate behavior.

Model Release (Excludable upon request)

The client agrees that the provider has the right to use any photographic portraits or pictures taken by the photo booth for promotional purposes, including advertising, trade, or other uses in any media now or in the future.

Internet Access

The provider's photo booth requires reliable internet access when sending image files instantly. In the event that the internet is unavailable, submissions will be queued and sent once the connection is restored. If no coverage is available at the event location, the provider will send all digital copies to the client and guests within seven days of the event.

Liability & Indemnity

The provider is not liable for any direct, indirect, incidental, or consequential damages arising from this agreement. The client agrees to indemnify and hold the provider harmless from any claims related to the event, except for claims caused by the provider's negligence.

Force Majeure

In the event that the provider cannot perform due to unforeseen circumstances (e.g., illness, act of God, or terrorism), the provider will make efforts to secure a replacement. If no replacement is found, the provider's liability is limited to a refund of the service fee.

Right To Safe Work Environment

The client ensures the provider's employees have a safe, harassment-free work environment. If the provider feels unsafe, they may remove equipment and cease services. The client will be responsible for any recovery costs.

Dispute Resolution

All disputes will be resolved through final and binding arbitration by a single arbitrator.

Severability

If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions will continue to be valid and enforceable.

Waiver

The failure to enforce any provision of this agreement does not waive the right to enforce it in the future.
